EU Right of Withdrawal Policy

This EU Right of Withdrawal Policy applies exclusively to consumers located in Italy, Ireland, Portugal, and Germany who purchase goods from Carnes Furniture through our official website. This Policy supplements but does not limit any mandatory consumer rights granted by applicable EU and local consumer protection laws.

1. Right to Withdraw

If you are a consumer resident in Italy, Ireland, Portugal, or Germany, you hold the legal right to withdraw from your online purchase contract within 14 calendar days without providing any reason or justification.

The 14-day withdrawal period commences on the day you, or a third party designated by you (excluding the shipping carrier), takes physical possession of the ordered goods.

For multi-shipment orders delivered in separate consignments, the withdrawal period expires 14 days after you or your authorized third party receives the final item of the order.

In the event that the withdrawal deadline falls on a weekend or public holiday, the deadline will be extended to the next official working day in accordance with applicable local law.

2. How to Exercise the Right of Withdrawal

To exercise your statutory right of withdrawal, you must submit a clear, unambiguous withdrawal statement to us before the expiration of the 14-day withdrawal period.

You may submit your withdrawal request via the dedicated "Exercise EU Right of Withdrawal" function available on our website, customer account dashboard, order status page, or official return portal (where applicable).

Alternatively, you may submit your withdrawal request via official email or complete and submit the model withdrawal form included below. Upon receipt of your electronic withdrawal request, we will send an official confirmation of receipt via email as a durable record.

4. Effects of Withdrawal

If you validly exercise your right of withdrawal, we will reimburse all payments received from you for the returned goods, including the cost of the least expensive standard outbound shipping option offered at checkout, as required by applicable EU consumer law.

We may withhold refund reimbursement until we have received and inspected the returned goods at our United States warehouse, or until you provide valid proof of shipment confirming the goods have been returned, whichever occurs first.

All approved refunds will be processed via the original payment method used for the transaction, unless you explicitly agree to an alternative refund method in writing.

5. Return of Goods

You must return the goods to our designated warehouse without undue delay, and no later than 14 days from the date you formally notify us of your withdrawal decision.

Unless the return is caused by our error, defective, damaged, incorrect, or non-conforming products, you are solely responsible for all direct international return shipping and freight costs incurred when returning goods from Italy, Ireland, Portugal, or Germany to our US facility.

Furniture, oversized goods, and freight items incur significant international return freight costs. Please contact our customer support team prior to arranging any return shipment to obtain official return instructions, designated return address, and freight guidance.

6. Reduction in Refund for Use or Damage

You are liable for any diminished value of the goods resulting from excessive handling, use, or damage beyond what is necessary to inspect the product’s nature, characteristics, and functionality.

All furniture items must be returned unassembled where possible, complete with all original parts, accessories, hardware, instruction manuals, and original factory packaging to avoid value deduction.

7. Exceptions to the Right of Withdrawal

The statutory 14-day withdrawal right does not apply to the following categories of goods, in accordance with EU consumer regulations: custom-made or personalized products manufactured to customer specifications; sealed hygiene products that have been unsealed after delivery; goods that become inseparably mixed with other items after delivery; and other exempt goods as permitted by applicable law.

8. Defective or Non-Conforming Goods

The EU statutory right of withdrawal is independent and separate from your legal rights regarding defective, damaged, incorrect, or non-conforming products. If you receive faulty, damaged, or misdescribed goods, please contact our support team promptly to initiate a quality claim, independent of the 14-day withdrawal window.
